Use of the App

Services are offered to individuals and companies, either conducting business activities independently or acting as consumers. For purposes of these STC, ‘consumer’ shall be interpreted as any individual or company using the Services for a purpose other than to conduct a business or commercial activity. If you are creating an account for your company, you understand and agree that said company would be understood to be the owner of the Account and, hence, any contents created using the Services and any data collected through the Services will be understood to belong to your company, unless otherwise agreed between you and your company.

a. Eligibility: You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

b. Account creation: In order to access the Services, you will need to register and create an account (the “Account”). To this end, you must provide true, current, complete, and accurate information, as requested during the registration process, that refers to you.

c. Beta Services

You may be offered to take part in early access programs to use so-called alpha or beta versions of the Services (“Beta Services”).

i. Beta Services may not work in accordance with the documentation we may provide you with, or they may contain errors, defects or bugs, as you acknowledge and agree.

ii. We do not make any sort of representations and warranties, and disclaim any liabilities regarding Beta Services.

iii. Beta Services may be discontinued at any time, for no reason and without prior notice, and nothing shall be construed as requiring us to release Beta Services as part of our regular Services.

d. Prohibited Conduct: You agree not to:

i. Use the App in any manner that violates any applicable laws, regulations, or third-party rights.

ii. Attempt to gain unauthorized access to the App, servers, or related systems or networks.

iii. Interfere with or disrupt the App's operation or the servers or networks connected to the App.

iv. Engage in any activity that could damage, disable, or impair the functionality or security of the App.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by QUE App and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Disclaimer of Warranties

The App is provided on an "as-is" and "as-available" basis without any warranties of any kind, whether express or implied. We do not warrant that the App will be error-free, uninterrupted, secure, or free from viruses or other harmful components. Your use of the App is at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, including but not limited to loss of profits, data, or goodwill.

Indemnification

You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including attorney's fees, arising out of or in connection with your use of the App, violation of these Terms, or infringement of any intellectual property or other rights of any person or entity.

Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any part thereof, with or without notice. We may also revise these Terms at any time, and such revised Terms will be effective immediately upon posting. Your continued use of the App after the posting of any changes to the Terms constitutes acceptance of those changes.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States of America.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement

These Terms constitute the entire agreement between you and QUE regarding the use of the App and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
